INJURY AND ILLNESS PREVENTION PROGRAM – Title 8, California Code of Regulations, §3203(a)(4), (6) and (7) – The proffered evidence showed the Employer established procedures regarding identification of workplace hazards, implemented its procedures for hazard correction and the IIPP contained written procedures for training and instruction.  JOB BRIEFINGS - Title 8, California Code of Regulations, §2940(g) – Employer failed to conduct additional job briefings when there were significant changes to the work involved.  SECURING UNSTABLE UTILITY POLES – Title 8, California Code of Regulations, §2940.8(f) - The proffered evidence showed Employer failed to guy, brace or otherwise securely support the pole after removal of the permanent guy wires. VIOLATION - SERIOUS CLASSIFICATION Labor Code §6432(a) – The Division established a rebuttable presumption that Citations 2 and 3 were properly classified as Serious. ACCIDENT-RELATED CHARACTERIZATION – The evidence established a causal nexus between the violation and the serious injury sufficient to sustain the accident-related character of Citation 3. ASSESSMENT OF CIVIL PENALTIES - Citation 1 was vacated by the ALJ.  Citations 2 and 3 were affirmed, and the proposed penalties were assessed.
